With respect to defendants convicted of conspiracy, it was error to deny motions for a new trial on the ground of newly discovered evidence that the prosecutor, without advising the defendants, had filed a nolle prosequi on the opening day of the trial on an indictment against a coconspirator who on the following day was the Commonwealth's sole witness to the existence of the conspiracy and who denied on cross-examination that he had an ""arrangement"" with the Commonwealth. [195] Conviction on an indictment charging that the defendant did conspire ""to administer, and cause to be administered, a drug, to two horses, with the purpose of affecting the speed of such horses in . . . a race,"" with a bill of particulars specifying the details of the scheme, was warranted by evidence that the defendant was aware that he was a party to an unlawful agreement having such a purpose, and it was not necessary to show that he knew the details of the agreement.
